Plaintiffs be granted leave to file a second amended consolidated complaint. These Findings and Recommendations will be submitted to the United States District Court Judge assigned to this action pursuant to the provisions of 28 U.S.C. 636 (b)(1). Within FOURTEEN (14) days after being served with a copy of these Findings and Recommendations, any party may file written objections with the court and serve a copy on all parties. As such, in light of having the heaviest district court caseload in the nation, limited Court resources, and the need to prioritize criminal and older civil matters over more recently filed actions, this Court strongly encourages the parties to consent to conduct all further proceedings before a U.S. Magistrate Judge.
