November 25, 2020 Opinion or Order Filing 6 MINUTE ORDER (Text Only Entry:) On November 24, 2020, the Court issued an order for Plaintiff to show cause why the complaint should not be dismissed for lack of subject matter jurisdiction. The Court issued this order because the complaint fails to adequately invoke diversity jurisdiction. Specifically, the citizenship of both Plaintiff and Defendant was not alleged in accordance with governing law. After the order to show cause was issued, Plaintiff filed a motion for writ of possession or in the alternative an ex parte temporary restraining order. However, because Plaintiff has failed to invoke the subject matter jurisdiction of this Court, the Court cannot issue either a writ of possession or a temporary restraining order. The Court hereby informs Plaintiff that, unless and until Plaintiff adequately invokes the Court's subject matter jurisdiction, the Court will not rule on Plaintiff's motion for a writ of possession or in the alternative an ex parte temporary restraining order.
