MEMORANDUM and ORDER signed by Judge Frank C. Damrell, Jr on 3/31/10 ORDERING the court concludes that the totality of the circumstances weighs in favor of allowing plaintiffs to amend their complaint and join Harrold Ford as a non-diverse defendant. Accordingly, plaintiffs' motion for leave to amend their complaint to join Harrold Ford is GRANTED. Because such joinder destroys diversity jurisdiction, that the action is REMANDED to the Superior Court of California in and for County of Sacramento. (Becknal, R)
