Plaintiffs, U.C. Davis students and recent graduates, alleged that the University of Davis campus police attacked their peaceful assembly, arrested them without probably cause and shot high-concentration pepper spray into their faces while the students were engaged in nonviolent protest. Plaintiffs seeks a declaration that campus policies and practices offend the state and federal constitutional guarantees of the rights to free speech and assembly that the pepper-spraying and arresting the plaintiffs violated their state and federal constitutional rights. Plaintiffs also seek an injunction to prevent repetition of such a response to a non-violent protest, as well as compensatory and punitive damages.
