October 17, 2018 Filing 68 MINUTE ORDER: The Court hereby GRANTS Defendants Motion for Sanctions for Plaintiffs Spoliation of Evidence, ECF No. 38. The 1999 Ford F-350 truck at issue in this case has been destroyed. Plaintiff could have reasonably anticipated this litigation and was under a duty to preserve the truck as evidence. Defendant has suffered prejudice from the spoliation of the truck. Plaintiffs failure to preserve the truck was not in bad faith or aimed at undermining the integrity of judicial proceedings. As such, dismissal of the case is inappropriate. Nevertheless, Plaintiffs failure to preserve the truck was at least negligent. Therefore, the jury will be provided the following instruction: Because Plaintiff failed to preserve the 1999 Ford F-350 Super Duty truck at issue in this case, and because Plaintiff did so without giving Ford Motor Company an opportunity to inspect or test the truck itself, you should infer that the truck, if preserved, would have provided evidence that was unfavorable to Plaintiff and favorable to Ford.
