(1) Bitdefender wants a copy of the Stoll report from the Finjan v. Juniper action. Stoll is Junipers expert on Finjans alleged inequitable conduct before the Patent Office. Bitdefender does not need Finjan to produce the Stoll report to it because Bitdefender has also retained Stoll in this action, and he has his own report and can give it to Bitdefender. Also, Bitdefender says that Juniper will happily give it the Stoll report. Finjan objects to this. As the Court explained during the call, in the absence of a protective order or other agreement that protects confidential information, documents produced in discovery can be shared with others. As a legal matter, the only thing that prevents a litigant from posting its adversarys documents on the internet or on billboards along the highway is an agreement not to do so or a protective order prohibiting that. So, Stoll and Juniper are presumptively free to give the Stoll report to Bitdefender if they want to, as long as doing so does not violate the protective order in the Finjan v. Juniper matter. Accordingly, the Court asked Finjan if Finjan believes it would be a violation of the protective order in the Finjan v. Juniper matter for Stoll or Juniper to provide Bitdefender with the Stoll report. Finjan said no, it would not be a violation because although the Stoll report cites and quotes many items marked confidential or highly confidential, Bitdefender already has all of those underlying items. To make sure there was no confusion, the Court repeatedly asked Finjan on the call whether Finjan thinks there would be a violation of the protective order in the Finjan v. Juniper matter for Bitdefender to be provided with the Stoll report, and Finjan repeatedly said no. Accordingly, the Court OVERRULES Finjans objection and holds that Stoll or Juniper may provide Bitdefender with the Stoll report. (2) Finjan wants Bitdefender to update its financial data with second quarter results, saying such updating is required by FRCP 26(e). Bitdefender says fact discovery is over and the deadline to move to compel has expired. The Court would like written briefing on this issue, in particular on the intersection of the continuing disclosure obligations under Rule 26(e) and the fact discovery cutoff and deadline to move to compel. Mr. Crosby stated that in preparation for this deposition he asked his paralegal to get him the witnesss prior deposition transcripts, and this one was included in what his paralegal provided. He stated that he is asking his team where it came from but does not have an answer at the moment (i.e., during the deposition). On this issue, the Court finds that Finjan has not established that Bitdefender obtained the unredacted transcript in an inappropriate way. The Court will not assume that Bitdefender participated in a violation of a protective order in another lawsuit in the absence of evidence of that. For example, it is possible that the third party whose confidential information was redacted gave the transcript to Bitdefender. If Bitdefender does not promptly provide Finjan with an acceptable explanation about how it obtained the unredacted transcript, Finjan may raise this issue again with the Court. The second issue is that Bitdefender has asked the witness several times whether his deposition preparation including trying to ascertain if Finjan marked a particular security appliance. The witness has apparently been responding that answering that question is outside the scope of his Rule 30(b)(6) designations. Bitdefender argues that it is entitled to ask a witness what he did to prepare. Finjan argues this question is outside the scope of the witnesss designated topics and invades the attorney-client privilege. The Court agrees with Bitdefender.
