ORDER Dismissing Complaint for Lack of Subject Matter Jurisdiction, Granting Plainti Leave to Amend, and Denying as Premature 24 Defendants' Motion to Dismiss: The first amended complaint is DISMISSED for lack of subject matter jurisdiction an d Plaintiff is GRANTED LEAVE TO AMEND. Defendants motion to dismiss pursuant to Rule 12(b)(6) is DENIED as premature; however, Defendants may resubmit the fully briefed motion as provided herein. If Plaintiff decides to amend the complaint, the secon d amended complaint must be filed no later than twenty-one (21) calendar days after this order is stamped Filed.
