ORDER granting 14 Motion to Proceed in forma pauperis; denying 17 Application for Certificate of Appealability. Petitioner has shown an inability to pay the filing fee. For the same reasons expressed in the Court's order denying Petitioner& #039;s Petition, the Court concludes that Petitioner has failed to make a substantial showing of the denial of a constitutional right. Accordingly, the Court grants Petitioner's motion to appeal in forma pauperis and denies Petitioner's request for a certificate of appealability. Signed by Judge Marilyn L. Huff on 6/24/2009.
