January 22, 2009 Opinion or Order Filing 34 ORDER For Preliminary Approval Of Class Action Settlement, Conditional Class Certification, Approval Of Class Notice, And Setting Of A Final Fairness Hearing (Re Doc. 28 ): The motion for order of preliminary approval of class action settlement is g ranted; and as a part of said preliminary approval, the Court accepts and incorporates the parties' Settlement Agreement and hereby temporarily and conditionally certifies the class for settlement purposes only pursuant to the terms and conditio ns contained in said Settlement Agreement. The Court approves the proposed Notice of Proposed Class Action Settlement and the Proposed Claim Form. Objections must be filed with the Court as described in the Class Notice on or before 3/23/2009. The Fi nal Approval Hearing shall be held at 02:00 PM on 5/27/2009. Briefs in support of the proposed Settlement shall be filed with the Court on or before 5/15/2009. Pending further order of this Court, all proceedings in this matter except those contemplated herein and in the Settlement Agreement are stayed.
