ORDER granting in part and denying in part Defendants' 28 Motion for Judgment on the Pleadings. Court dismisses w/ prejudice Pla's 1985 and 1986 claims because amendment would be futile. Court dismisses w/o prejudice Pla's claim base d upon a retaliatory prosecution. Counsel indicated the MBC proceedings are going forwarded on 1/26/2009. In order to give Pla time to evaluate the outcome of the proceedings, Court grants leave to amend w/in 90 days of this Order to cure the deficiencies. Signed by Judge Irma E. Gonzalez on 1/21/2009.
