ORDER DISMISSING CASE Without Prejudice: The Court dismisses the case without prejudice for Petitioner's failure to: (1) satisfy the filing fee requirement, (2) state grounds for relief in the Petition, (3) name a proper respondent, (4) allege e xhaustion of state judicial remedies, and (5) use a court-approved form. If Petitioner wishes to proceed with this case, he must submit, no later than 5/6/2009, a copy of this Order with the $5.00 fee or with adequate proof of his inability to p ay the fee AND a First Amended Petition which cures the pleading deficiencies noted. The Clerk of Court is directed to send a blank Southern District of California In Forma Pauperis Application and a First Amended Petition form to Petitioner along with a copy of this Order.
