ORDER Granting in part 9 Defendants' Motion to Dismiss and Denying Their Motion to Strike: Defendants motion to dismiss the First Amended Complaint is GRANTED with respect to the negligent misrepresentation claim only, and DENIED in all other respects. Their motion to strike is DENIED. Plaintiff is GRANTED LEAVE TO AMEND.
