Filing 15 ORDER : (1) Dismissing First Amended Complaint for Failing to State a Claim; and (2) Dismissing Action for Failing to Exhaust Available Administrative Remedies. It is hereby ordered that Plaintiff's First Amended Complaint is Dismiss without pre judice for failing to state a claim upon which relief may be granted pursuant to 28 U.S.C. § 1915(e)(2)(B) and § 1915A(b). In addition, Plaintiff's entire action is Dismissed, without prejudice for failing to exhaust his available administrative remedies prior to bringing suit pursuant to 42 U.S.C. § 1997e.
