ORDER granting in part and denying in part 10 Motion to Dismiss and 11 Motion to Strike. The Motion to Dismiss is granted as to all causes of action brought by Sharts and Terry. All causes of action in the Counterclaim brought by Sharts and Terr y are dismissed without prejudice. The causes of action in the Counterclaim for breach of employment/non-disclosure/non-compete contract, intentional misrepresentation and negligent misrepresentation are dismissed without prejudice. Defendants' first, fourth, fifth, thirteenth, fourteenth, sixteenth, eighteenth, nineteenth and twentieth affirmative defenses are stricken.
