ORDER Dismissing sua sponte Complaint and denying as moot 3 Motion to Appoint Counsel and 2 Motion for Leave to Proceed in forma pauperis: This Court finds that plaintiff's complaint fails to state a claim under the RICO statute. The Court dismisses the instant complaint, sua sponte, for failure to state a claim upon which relief may be granted. Plaintiff's Motion to Proceed in forma pauperis and motion for appointment of counsel are denied as moot. Signed by Judge John A. Houston on 7/27/10.
