We have reviewed appellant's emergency motion, which requests that the USCA "clarify that the government may not act on [the] lower court's order of removal until this Court concludes its review in these habeas proceedings." By this order, we express no opinion as to whether Federal Rule of Appellate Procedure 23(a) applies to the USDC's removal order, which was entered in a USDC case not challenged on appeal. To the extent appellees request dismissal of this appeal for lack of jurisdiction, that request is denied without prejudice to renewing the arguments in the answering brief.
