We have reviewed appellant's emergency motion, which requests that the USCA "clarify that the government may not act on [the] lower court's order of removal until this Court concludes its review in these habeas proceedings." The emergency motion is denied. By this order, we express no opinion as to whether Federal Rule of Appellate Procedure 23(a) applies to the USDC's removal order, which was entered in a USDC case not challenged on appeal. To the extent appellees request dismissal of this appeal for lack of jurisdiction, that request is denied without prejudice to renewing the arguments in the answering brief. The motion to expedite is denied. The opening brief has been filed. The briefing schedule previously established remains in effect. (akr)
