                ORDER entered: On September 16, 2019, appellant filed a motion to vacate, alter and amend the August 20, 2019 order that remains pending with the district court (D.E. No. 31). Pursuant to Fed. R. App. P. 4 (a)(4)(B), the notice of appeal from the March 29, 2019 order does not become effective until the district court disposes of the pending Rule 59 and 60 motion. Therefore, the briefing schedule is vacated and appellant is directed to file a status report by October 21, 2019 and at thirty-day intervals thereafter, informing this court of any action taken by the district court on the Rule 59 and 60 (D.E. 31). Further, the appellant is directed to inform this court whether he intends to file a notice of appeal or amended notice of appeal from the district court's order disposing of that motion. Failure to comply with this order may lead to dismissal of this appeal for lack of diligent prosecution.
