MOTION to extend time to file brief filed by Appellant Sharon Meehan. Served on 04/28/2022. [22-1147] (AL) [Entered: 05/02/2022 10:01 AM] |
ORDER entered by Sandra L. Lynch, Appellate Judge; Rogeriee Thompson, Appellate Judge and Gustavo A. Gelpi, Jr., Appellate Judge: Appellant Sharon Meehan has filed an "Emergency Motion to Stay" in this court. We review under traditional stay/injunction principles. See Bos. Parent Coal. for Acad. Excellence Corp. v. Sch. Comm. of City of Bos. , 996 F.3d 37, 44 (1st Cir. 2021) (explaining factors relevant to a motion for stay pending appeal, as well as the "higher bar" when evaluating those same factors in the context of an appellate motion for injunctive relief). Appellant filed motions simultaneously in this court and the district court (but later withdrew the motion to the district court). In the ordinary course, such a motion should first be made to the relevant district court, and the course followed here is procedurally unsound. See Fed. R. App. P. 8(a). Even if we did not deny the motion on this basis, however, Appellant has not demonstrated entitlement to either a stay or injunctive relief. Appellant's motion is DENIED.
