ORDER (Clerk) denying as moot motion to to stay. There is no basis for granting that relief. The obligation to pay the filing and docketing fees immediately attached upon the filing of an appeal. The Court will not make that obligation contingent on a determination concerning jurisdiction. If a party wishes to prosecute an appeal, they must be prepared to comply with fee requirements. The foregoing motion to vacate is denied without prejudice to renewal after the $255.00 in filing and docketing fees have been paid or a motion for leave to proceed in forma pauperis accompanied by the required affidavit, authorization for withdrawals from appellant's prison account, certified statement of prison account and a motion demonstrating that the subject matter of the appeal concerns a matter placing appellant in serious physicial injury. In no event would the appellant be permitted to proceed with the appeal with compliance with 28 U.S.C. section 1915(g), filed. (CMH) [Entered: 08/17/2005 09:03 AM]
