CLERK ORDER dismissing case, pursuant to F.R.A.P. 3(a) and LAR 3.3 and Misc. 107.1(a), for failure to pay the filing fee for the petition. Case terminated on 06/18/2019. (NR) [Entered: 06/18/2019 09:13 AM] |
NONCOMPLIANCE Order sent to Petitioner Lewis Jordan. Action on the petition for writ of mandamus is hereby deferred. Petitioner did not submit the filing fee or a motion for leave to proceed in forma pauperis with the mandamus petition. Within 14 days of the date of this order, Petitioner must either file a motion for leave to proceed in forma pauperis and affidavit or remit payment of the $500.00 filing fee. The motion must be accompanied by a certified statement of Petitioner's institutional account. A certificate of service reflecting that the petition and motion have been served must be submitted to the Court of Appeals within 14 days of the date of this Order. It is noted that on May 1, 2019, the District Court dismissed Petitioner's habeas petition docketed at E.D. Pa. No. 2-19-cv-00086. After Petitioner has filed the documents in this Court required for the mandamus petition to be deemed compliant, Petitioner must file a response within 10 days addressing whether the mandamus petition should be dismissed as moot in light of the District Court's May 1, 2019 order.
