Filing 8 MOTION filed by Appellant Carmencita Maria Pedro to Proceed In Forma Pauperis. (PDB) [Entered: 11/16/2021 03:12 PM] |
Filing 6 ORDER (Clerk) Appellant's motion for stay was filed in appeal No. 21-2317 on October 7, 2021, prior to the filing and docketing of appeal No. 21-2903. Insofar as appeal Nos. 21-2317 and 21-2903 have now been consolidated for all purposes, the motion to stay is considered in both cases. It is noted that Appellant is seeking to stay these proceedings for a period of sixty (60) days as she continues to litigate a separate matter in the United States District Court for the Eastern District of Pennsylvania, Pedro v. City Fitness LLC, No. 2-15-cv-04964. Appellant's motion to stay these proceedings is GRANTED, and the appeals at Nos. 21-2317 and 21-2903 are hereby STAYED until December 27, 2021. On or before expiration of the stay, Appellant must file a response to the Clerk's order listing appeal No. 21-2317 for possible dismissal pursuant to 28 U.S.C. Section 1915(e)(2) or for summary action under 3rd Cir. L.A.R. 27.4 and I.O.P. 10.6. In the event a further stay is necessary, Appellant must file a motion requesting such relief prior to December 27, 2021. Any subsequent motion to continue the stay must be based on extraordinary circumstances and must set forth in sufficient detail why the appeals should continue to be stayed pending the unrelated district court proceedings, filed. [21-2317, 21-2903] (PDB) [Entered: 11/01/2021 09:33 PM] |
