ORDER (Clerk) The plaintiffs originally appealed after the district court dismissed their complaint in May 2024 (3d Cir. No. 24-2026). Their appeal was dismissed in April 2025 because the plaintiffs did not file a timely appellate brief, and the Court later declined to reopen that appeal. After their appeal was dismissed, the plaintiffs filed a Fed. R. Civ. P. 60(b) motion in the district court. In July 2025, the district court denied that motion and scheduled oral argument on a defendants pending motion for sanctions. The plaintiffs and their counsel jointly filed a second appeal from these orders (3d Cir. No. 25-2443). The plaintiffs counsel filed another appeal after the district court, among other things, denied his request to seal parts of the sanctions proceedings (3d Cir. No. 25-2856). The plaintiffs and their counsel moved to stay these two appeals pending completion of the district-court proceedings, but this Court denied the motion. The appeals were later dismissed because neither the plaintiffs nor their counsel filed a timely appellate brief. In July 2026, the district court concluded the sanctions proceedings by ordering the plaintiffs counsel to pay about $27,000 in sanctions. The plaintiffs filed an amended notice of appeal from this order. Then their counsel did, too. Because Fed. R. App. P. 4(a)(4) did not appear to apply and, in any event, the prior appeals were already dismissed, the Clerk opened a new docket for the plaintiffs notice of appeal (3d Cir. No. 26-3169). Their counsels amended notice of appeal was included on the same docket, adding him as an additional appellant. If this appeal proceeds to briefing, the parties must address appellate jurisdiction in their briefs. Among any other relevant issues, they must address whether the plaintiffs have standing to challenge the July 2026 sanctions order and whether the plaintiffs notice of appeal was timely with respect to any earlier orders they do have standing to challenge. These jurisdictional issues regarding the scope of this appeal are REFERRED to the merits panel. (AMR) [Entered: 10/07/2026 12:01 PM]

Their counsels amended notice of appeal was included on the same docket, adding him as an additional appellant. The Clerk informed the appellants they must pay the filing and docketing fees for the new appeal. The appellants have now moved for a determination that no additional fee is due pursuant to Rule 4(a)(4)(B)(iii). Their motion is REFERRED to a motions panel of this Court.
