Filed opinion of the court by Judge Wood. We AFFIRM the district court's grant of Defendants' motion under Federal Rule of Civil Procedure 60(b)(4). We also AFFIRM the district court s denial of Philos Tech s motion under Rules 60(b)(3), (b)(6), and (d)(3). We conclude, finally, that the district court erred in imposing sanctions on Philos Tech, and so we VACATE its sanctions order. Each side must bear its own costs on appeal. Diane P.
