April 10, 2019 Opinion or Order Filing 7 ORDER re: Status report and request for permission to supplement the record. [ # 6 ] To the extent the pro se appellant seeks to supplement the record on appeal, the request is DENIED WITHOUT PREJUDICE. Before moving to supplement the record on appeal, the appellant must file a formal motion to supplement the record with the district court, accompanied by whatever documents he seeks to add to the record, and await a ruling by that court. See 7th Circ. R. 10(b). He can renew his motion in this court if he is dissatisfied with the district court's ruling. He is cautioned that documents cannot be added to the record on appeal if they were not presented to the district court before it entered judgment. See Gallo v. Mayo Clinic Health System-Franciscan Medical Center, Inc., 907 F.3d 961, 964 (7th Cir. 2018). Any documents that were filed in the district court before it entered judgment will automatically be part of the record on appeal, and there is no need for the appellant to file a motion to supplement the record related to such documents. April 5, 2019 Opinion or Order Filing 5 ORDER re: Motion for enlargement of time. IT IS ORDERED that the motion is GRANTED to the extent that the petitioner shall file his response to the court's order dated March 20, 2019, by no later than April 22, 2019. If the petitioner would like to file a separate motion for a certificate of appealability, he may do so by May 6, 2019. In the event that the petitioner does not file a motion by that date, his notice of appeal previously docketed in this court will be deemed to constitute an application for a certificate of appealability. See Fed. R. App. P. 22(b)(2). Finally, to the extent that the petitioner seeks an extension of time to file his opening brief, that request is DENIED. Because the petitioners request for a certificate of appealability remains pending, no brief is due at this time. The clerk will set a briefing schedule automatically if this court should issue a certificate of appealability.[ # 4 ] CMD [5] [6995883] [19-1493] (AP) [Entered: 04/05/2019 02:27 PM]
