February 26, 2021 Opinion or Order Filing 5 ORDER: On February 22, 2021, the appellant filed a notice of appeal from the district court's judgment and its order denying reconsideration, and appeal no. 21-1320 was opened. On February 23, 2021, the appellant filed a second notice of appeal, and appeal no. 21-1333 was opened. Both filings seek to challenge the same district court judgment and denial of reconsideration, and two separate appeals are not necessary. Accordingly, the appeal no. 21-1333 is administratively CLOSED. No appellate filing fees for appeal no. 20-1333 shall be imposed. SCR [5] [7144322] [21-1320] (FP) [Entered: 02/26/2021 03:35 PM]
February 26, 2021 Opinion or Order Filing 4 ORDER re: 1) Motion to continue in forma pauperis status. 2) Appointment of counsel request. This appeal is subject to the Prison Litigation Reform Act and all proceedings are suspended pending the assessment and payment of any necessary fees. See Newlin v. Helman, 123 F.3d 429, 434 (7th Cir. 1997). A review of the docket indicates that the appellant's motion to proceed on appeal in forma pauperis is currently pending before the district court and, therefore, the appellant's fee status is unresolved. Accordingly, IT IS ORDERED that the motion to continue in forma pauperis status is DENIED without prejudice to renewal should the district court deny the pending motion to proceed on appeal in forma pauperis. IT IS FURTHER ORDERED that the motion for appointment of counsel is DENIED without court action, pursuant to the court's fee notice and order dated February 22, 2021.
