Filing 15 Amended Docketing Statement filed by Appellee Great Divide Insurance Company. Prior or Related proceedings: No. [15] [7243516] [22-1725] (Eastham, James) [Entered: 06/21/2022 12:30 PM] |
Filing 14 ORDER: A review of the Amended Docketing Statement filed by appellee on June 13, 2022, reveals that it remains inadequate. Appellee has not established the timeliness of this appeal. Specifically, appellee provides no information regarding the date of the filing of a post-judgment motion for reconsideration and the date of its disposition. This information must be provided. See Circuit Rule 28(a)(2)(ii), (iii). Accordingly, appellee again shall file an amended docketing statement that is complete and contains the omitted information noted above. This statement must be filed no later than June 21, 2022. DW [14] [7242332] [22-1725] (HTP) [Entered: 06/14/2022 10:59 AM] |
Filing 13 Amended Docketing Statement filed by Appellee Great Divide Insurance Company. Prior or Related proceedings: No. [13] [7242140] [22-1725] (Eastham, James) [Entered: 06/13/2022 02:43 PM] |
Filing 12 Amended Jurisdictional Statement filed by Appellants Jessie McGee and Linda McGee. Prior or Related proceedings: No. [12] [7241948] [22-1725] (LCP) [Entered: 06/13/2022 09:33 AM] |
Filing 11 ORDER: This appeal is REMANDED to the district court to enter a judgment that fully and completely implements its decision, declaring specifically and separately the respective rights of all the parties. See Fed. R. Civ. P. 60(a); Fed. R. App. P. 12.1. Once the district court has done so, the appeal will proceed to briefing. An amended notice of appeal is unnecessary; the original appeal will come into force once a proper judgment has been entered. See Fed. R. App. P. 4(a)(2); cf. Philadelphia Indemnity Ins. Co. v. The Chicago Trust Co., 930 F.30 910, 912 (7th Cir. 2019). IT IS FURTHER ORDERED that appellee inform the court, no later than June 30, 2022, whether the district court has entered its amended judgment. FOR COURT USE ONLY: Certified copy of 06/10/2022 Limited Remand Order sent to the District Court Clerk. [7241836-2] [7241836] [22-1725] (AP) [Entered: 06/10/2022 03:11 PM] |
Filing 10 ORDER: In the present case, plaintiff relies on diversity of citizenship for federal jurisdiction. However, appellees Circuit Rule 3(c) docketing statement fails to identify the state of citizenship of defendants Linda Construction, Inc. and Seng Leasing Services, Inc. Appellee must provide this information since the existence of diversity jurisdiction is based on the parties in the district court. The fact that the two defendants are not parties to the instant appeal is irrelevant to determining diversity jurisdiction. Further, appellee must provide the date of the order appealed and the date the notice of appeal was filed. It is insufficient to incorporate by reference the facts establishing appellate jurisdiction. Accordingly, the appellee shall provide a complete docketing statement no later than June 13, 2022. (See order for further details.) DW [10] [7240887] [22-1725] (FP) [Entered: 06/07/2022 09:50 AM] |
