                Filed District Court order DENYING Appellant James H. Garner leave to proceed on appeal in forma pauperis. Date IFP denied: 01/27/2023. Plaintiff moves for substitution of judge [62], which the Court construes as a motion for recusal. Plaintiff raises no proper grounds as to why recusal is warranted. That is because, as previously stated [61], there are none. Plaintiff's motion is denied. For the same reasons, Plaintiff's motion to reconsider the 1/11/2023 order [66]which the Court interprets as requesting reconsideration of the holding that there is no basis for recusal is denied. Next, Plaintiff moves for leave to proceed in forma pauperis on appeal [65]. As part of the Court's review of Plaintiff's motion, the Court must determine whether the appeal is taken in good faith. 28 U.S.C. 1915(a)(3). The relevant inquiry is not whether Plaintiff sincerely believes appellate review is necessary, but whether the appeal objectively raises a nonfrivolous issue. Larry v. Hoening, No. 18 C 2752, 2018 WL 9989441, at *1 (N.D. Ill. Oct. 26, 2018) (Kendall, J.) (citing Cruz v. Hauck, 404 U.S. 59, 62 (1971) (Douglas, J. concurring)). Plaintiff appeals the Executive Committee's reassignment of his case to this Court after Judge Valderrama's recusal. Because there is no valid basis for appealing the order, Plaintiff's IFP petition is denied. Finally, Plaintiff has filed two motions "to render fair timely notice" [67, 75]. The Court construes the filings as notice of Plaintiff's motions before the appellate court. To the extent it is docketed as a motion, the Court strikes it as moot Issued Circuit Rule 3(b) 30 day notice for failure to pay the docketing fee.
