Filing 6 ORDER re: Circuit Rule 3(c) docketing statement and request to withdraw appeal without prejudice. [ # 5 ] The appellant has asked the court to dismiss this appeal without prejudice. Federal Rule of Appellate Procedure 42(b) allows an appellant to voluntarily dismiss his appeal. However, once the appeal is dismissed, the appellant cannot reinstate it at a later date. Because it appears that the appellant may wish to reserve the right to reopen this appeal at a later date, the request is DENIED. Should the appellant decide that he does not want to proceed with this appeal, then he may file an appropriate motion, that complies with Fed. R. App. P. 42(b) by July 20, 2023. To the extent that the appellant would like this filing to serve as his Circuit Rule 3(c) docketing statement, the request is DENIED because the filing does not comply with the courts rules. The clerk shall resend the appellant this courts instructions for preparing a docketing statement so the appellant may familiarize himself with the information that must be included in a Circuit Rule 3(c) docketing statement. In his docketing statement, the appellant should attempt to provide the information listed in the Pro Se Instructions, particularly the date of the judgment or order being challenged in this appeal. The deadline for filing the Circuit Rule 3(c) docketing statement is extended to July 20, 2023. Finally, the deadline for the appellant to either pay the $505.00 appellate filing fees or file a motion for leave to proceed on appeal in forma pauperis with the clerk of the district court is extended to July 20, 2023.
