ORDER re: Motion for court to establish a briefing schedule. A review of the court's docket indicates that this appeal may not proceed without a certificate of appealability. Because the appellant's request for a certificate of appealability is currently pending before this court, no brief is due at this time. Accordingly, to the extent that the appellant seeks to establish a briefing schedule, the motion is DENIED. The appellant is reminded that the court will set a briefing schedule automatically should it grant his request for a certificate of appealability. If the appellant would like to file a separate request for a certificate of appealability with this court, he may do so by January 15, 2025. In the event that the appellant does not file a motion by that date, his notice of appeal previously docketed in this court will be deemed to constitute an application for a certificate of appealability.
