                ORDER: Appellant shall file, on or before January 16, 2025, a brief memorandum stating why this appeal should not be dismissed for lack of jurisdiction. The memorandum should also address whether any of appellants filings between January 11, 2024, and February 7, 2024, may be construed as a timely notice of appeal, see Smith v. Barry, 502 U.S. 244, 248 (1992), or whether appellants January 11, 2024, statement on the plaintiffs selection may be construed as a timely motion to alter or amend the judgment under Rule 59 of the Federal Rules of Civil Procedure, see Carlson v. CSX Transp., Inc., 758 F.3d 819, 82526 (7th Cir. 2014). A notice of appeal filed before the district court issues its ruling on a timely motion under Rule 59 of the Federal Rules of Civil Procedure is ineffective until the order disposing of the motion is entered on the district courts civil docket, Fed. R. App. P. 4(a)(4), so if the statement may be construed as such a motion, this appeal would be rendered premature and proceedings will be suspended pending an order disposing of the statement. A motion for voluntary dismissal under Rule 42(b) of the Federal Rules of Appellate Procedure will satisfy these requirements. Briefing is SUSPENDED pending further court order.
