Accordingly, IT IS ORDERED that the motion for an evidentiary hearing is DENIED as unnecessary. This appeal will proceed to briefing. Briefing will proceed as follows: [ # 10 ] Appellant's brief due on or before 06/22/2026 for Lorenzo Johnson. Appellees' brief due on or before 07/22/2026 for Wayne Bauer, Amy Denneau, Robert Drehmel, Brian Foster, Warden, Cheryl Jeanpierre, Mary A. Moore, Robert Weinman and Amber Wendrick. ORDER: Appellant shall file, on or before March 9, 2026, a brief memorandum stating why this appeal should not be dismissed for lack of jurisdiction. The memorandum should address whether appellants motion for extension of time may be construed as a notice of appeal, see Smith v. Barry, 502 U.S. 244, 248 (1992); Owens v. Godinez, 860 F.3d 434, 437 (7th Cir. 2017), rendered timely by the later order granting the motion. See Parrish v. United States, 605 U.S. 376, 387 (2025). Appellant may also file, with the memorandum, a notarized statement or declaration (in compliance with 28 U.S.C. 1746) setting forth the date the notice of appeal was deposited in the prisons internal mail system and stating whether first class postage was prepaid. See Fed. R. App. P. 4(c). A motion for voluntary dismissal under Rule 42(b) of the Federal Rules of Appellate Procedure will satisfy this requirement. Briefing is SUSPENDED pending further court order. (See order for further details) [7506705] JXK [6] [7506705] [25-3177] (AP) [Entered: 02/23/2026 02:09 PM]
