Filed District Court order dated 09/21/2026. The court's previous order denying plaintiff's motion for an extension of time to file his appeal (dkt. [13]) is VACATED. Upon further review, the court discovered that it miscalculated the timeliness of plaintiff's motion. Under Fed. R. App. P. 4(a)(5)(A)(i), plaintiff has 30 days after the expiration of the 30-day appeal deadline to move for an extension. Because plaintiff filed his motion only one day after his appeal deadline expired on September 16, it is timely. Rule 4(a)(5)(A)(ii) further requires that plaintiff show excusable neglect or good cause. Here, plaintiff explains that he waited to file his notice of appeal until he had the funds to pay the appellate filing fee, because he mistakenly understood that he had to pay the filing fee at the same time he filed the appeal. Finding plaintiff's reasoning excusable and no prejudice resulting from a one-day extension, IT IS ORDERED that plaintiff's motion for a one-day extension of his deadline to appeal (dkt. #[11]) is GRANTED. ORDER: Rule 4(a) of the Federal Rules of Appellate Procedure requires that a notice of appeal in a civil case be filed in the district court within 30 days of the entry of the judgment or order appealed. In this case judgment was entered on May 18, 2026, and the district court denied a timely motion to alter or amend the judgment on August 17, 2026. The notice of appeal was then filed on September 17, 2026, one day late. A review of the district courts docket suggests the appellant has filed motion for an extension of time to file a notice of appeal, see Fed. R. App. P. 4(a)(5), but the district court has not yet ruled on that motion. Accordingly, proceedings in this appeal are SUSPENDED pending the district court's resolution of the motion for extension of time. Further, appellant shall file a status report within seven days of a ruling on the motion for extension of time, or on or shortly before October 19, 2026, if no order has yet issued.
