ORDER: Proceedings in this appeal are SUSPENDED pending the district court's resolution of the motion to amend to dismiss remaining claims with prejudice. If a party contends that this appeal should not be suspended, then that party should file a brief memorandum on or before November 3, 2026, stating why suspension is not appropriate. Appellants shall file a status report within seven days of a ruling on the motion to amend, or on or shortly before November 20, 2026, if no order has yet issued. In any status report regarding the district courts ruling, appellants must address whether the district courts ruling has resulted in a final decision under 28 U.S.C. 1291 and whether this appeal is effective to challenge any such decision under Rule 4(a)(2) of the Federal Rules of Appellate Procedure. A motion for voluntary dismissal under Rule 42(b) of the Federal Rules of Appellate Procedure will satisfy this requirement.
