ORDER: Appellant shall file, on or before November 18, 2026, a brief memorandum stating why this appeal should not be dismissed for lack of jurisdiction. The memorandum should address whether appellants motion for extension of time to appeal may be construed as a timely notice of appeal. See Smith v. Barry, 502 U.S. 244, 248 (1992); Owens v. Godinez, 860 F.3d 434, 437 (7th Cir. 2017). If appellant contends that the notice of appeal or the motion to alter or amend the judgment was timely mailed under the prison-mailbox rule, then he must file, with the memorandum, a notarized statement or a declaration (in compliance with 28 U.S.C. 1746) setting forth the date the notice of appeal or motion to alter or amend the judgment was deposited in the prisons internal mail system and stating whether first class postage was prepaid. See Fed. R. App. P. 4(c). A motion for voluntary dismissal under Rule 42(b) of the Federal Rules of Appellate Procedure will satisfy this requirement. Briefing is SUSPENDED pending further court order. (See order for further details) [7567987] JXK [2] [7567987] [26-3270] (AP) [Entered: 11/04/2026 02:33 PM]
