Filing 9028646806 Filed Order for PUBLICATION CERTIFYING A QUESTION TO THE OREGON STATE SUPREME COURT (RICHARD R. CLIFTON, MARY H. MURGUIA and JACQUELINE H. NGUYEN) (MHM authoring) (SEE ORDER FOR FULL TEXT) We respectfully ask the Oregon Supreme Court to exercise its discretionary authority to accept and decide this question. Our phrasing of the question should not restrict the Oregon Supreme Court s consideration of the issues involved, and we recognize that [the Oregon Supreme Court] may reformulate the question. Queen Anne Park Homeowners Ass n v. State Farm Fire & Cas. Co., 763 F.3d 1232, 1235 (9th Cir. 2014). If the Oregon Supreme Court declines certification, we will resolve the question according to our best understanding of Oregon law. Further proceedings in this court are stayed pending receipt of the answer to the certified question. The clerk of this court shall forward a copy of this order, under official seal, to the Oregon Supreme Court, along with copies of all briefs and excerpts of record that have been filed with this court. The parties shall notify the clerk of this court within one week of any decision by the Oregon Supreme Court to accept or decline certification. If the Oregon Supreme Court accepts certification, the parties shall then notify the clerk of this court within one week of the issuance of that court s opinion. IT IS SO ORDERED [10246252] |
