Order filed (Appellate Commissioner) Appellant appeals the order of the Magistrate Judge entered on the docket on January 30, 2019. An appeal of right from an order imposed by a Magistrate Judge shall lie to a judge of the district court in which the offense was committed. See 18 U.S.C. 3402. The appeal, therefore, must first be brought in the district court before prosecution in the court of appeals. See United States v. Soolook, 987 F.2d 574, 575 (9th Cir. 1993) (order). Accordingly, the Clerk shall close this appeal as opened in error. The notice of appeal filed on April 1, 2019, may now be processed by the Clerk of the district court. See id.
