September 26, 2019 Filing 3 Filed clerk order (Deputy Clerk: KMB): Appellants notice of appeal, filed in the district court on September 26, 2019, states his intent to appeal from the district courts September 3, 2019, judgment. A review of the record suggests that this court may lack jurisdiction over this appeal because the district court granted appellants September 10, 2019, motion for reconsideration and vacated the September 3, 2019 judgment. See 28 U.S.C. 1291. On September 20, 2019, the district court entered a new judgment dismissing the case without prejudice. It appears that the new judgment may have crossed in the mail with appellants notice of appeal. To date, appellant has not filed a notice of appeal from the new judgment entered on September 20, 2019. Within 21 days after the date of this order, appellant shall move for voluntary dismissal of the appeal or show cause why it should not be dismissed for lack of jurisdiction. If appellant elects to show cause, a response may be filed within 10 days after service of the memorandum.
