Filing 7 Filed order (Interim Appellate Commissioner): Upon further review of the record and appellants unopposed motion to consolidate these appeals, the court discharges the December 18, 2020, order to show cause issued in No. 20-36031. Appellants motion to consolidate (Docket Entry Nos. [ # 11979078-2 ] & [ # 11982000-2 ] in No. 20-36031) is granted. Appeal Nos. 20-36031 and 21-35017 are consolidated. The record reflects that appellees timely filed in the district court a motion listed in Federal Rule of Appellate Procedure 4(a)(4). Proceedings other than mediation in these consolidated appeals are therefore in abeyance pending the district courts resolution of the post-judgment motion. See Leader Natl Ins. Co. v. Indus. Indem. Ins. Co., 19 F.3d 444, 445 (9th Cir. 1994). Within 7 days after the district courts ruling on the motion, appellant must notify this court in writing of the ruling and state whether appellant intends to prosecute these consolidated appeals. To appeal the district courts ruling on the post-judgment motion, appellant must file an amended notice of appeal within the time prescribed by Federal Rule of Appellate Procedure 4. The Clerk will serve this order on the district court. (MOATT) [11988107] [20-36031, 21-35017] (TSP) [Entered: 02/01/2021 12:54 PM] |
