See 28 U.S.C. 1291; Fed. R. Civ. P. 54(b); Romoland Sch. Dist. v. Inland Empire Energy Ctr., LLC, 548 F.3d 738, 747 (9th Cir. 2008) (noting that an order that disposes of fewer than all claims against all parties is not immediately appealable unless the district court enters judgment pursuant to Fed. R. Civ. P. 54(b)); WMX Techs., Inc. v. Miller, 104 F.3d 1133, 1136 (9th Cir. 1997) ([A] plaintiff, who has been given leave to amend, may not file a notice of appeal simply because he does not choose to file an amended complaint. A further district court determination must be obtained.); United States v. Washington, 573 F.2d 1121, 1122 (9th Cir. 1978) (holding that an order denying a motion to disqualify a district court judge is not immediately appealable under the collateral order doctrine). Accordingly, this appeal is dismissed for lack of jurisdiction. Appellants request to treat the notice of appeal as a petition for writ of mandamus is denied because appellants do not demonstrate that this case warrants the intervention of this court by means of the extraordinary remedy of mandamus.
