SANCHEZ) A review of the record and the responses to the courts November 23, 2022, order to show cause demonstrates that this court lacks jurisdiction over this appeal because the orders challenged in the appeal are not final or appealable. See 28 U.S.C. 1291; Fed. R. Civ. P. 54(b); Bird v. Reese, 875 F.2d 256, 256 (9th Cir. 1989) (noting that an order denying a motion for default judgment is not a final appealable order); Joseph v. Off. of Consulate Gen. of Nigeria, 830 F.2d 1018, 1028 (9th Cir. 1987) (A district courts grant of a motion to set aside a default judgment is not an appealable final order, where the setting-aside paves the way for a trial on the merits.). Nor may the appeal proceed under 28 U.S.C. 1292(b) where the district court has not issued the required certification. See 28 U.S.C. 1292(b). Accordingly, this appeal is dismissed for lack of jurisdiction. The motion to take judicial notice (Docket Entry No. [ # 6 ]) and the motion for an injunction pending appeal (Docket Entry No. [ # 7 ]) are denied as moot. DISMISSED.
