                ORDER FILED. The notice of appeal filed January 28, 2026 challenges the order entered in the district court on December 5, 2025 denying in forma pauperis requests for Maritza Miranda and Edwidge Mondesir, Sr., and dismissing them from the case. It appears that the January 28, 2026 notice of appeal and the in forma pauperis motion filed in this court on December 19, 2025 on behalf of Edwidge Mondesir, Sr., were signed only by Edwidge Mondesir, Jr. See McKinney v. Debord, 507 F.2d 501 (9th Cir. 1974) (pro se appellant must personally sign notice of appeal); see also Becker v. Montgomery, 532 U.S. 757, 765 (2001) (pro se litigants failure to sign the notice of appeal is a non-jurisdictional, and therefore, curable defect); see also McShane v. United States, 366 F.2d 286, 288 (9th Cir. 1966) (non-attorney litigants may not represent other individual litigants). Within 21 days, appellant Edwige Mondesir, Sr., must file a personally signed copy of the notice of appeal in the district court. If appellant Edwige Mondesir, Sr., does not do so, the court will dismiss this appeal. See 9th Cir. R. 42- 1. It appears that this appeal may be frivolous. If the appeal is frivolous, the court will deny permission to proceed in forma pauperis and dismiss the appeal. See 28 U.S.C. 1915(e)(2). Within 35 days, appellant Edwige Mondesir, Sr., must: (1) file a statement explaining why the appeal is not frivolous and a motion to proceed in forma pauperis personally signed by appellant Edwige Mondesir, Sr., OR (2) file a motion to voluntarily dismiss the appeal, see Fed. R. App. P. 42(b). If appellant files a statement explaining why the appeal is not frivolous, or any other response other than a motion to dismiss, the court will determine whether the appeal is frivolous. If it is frivolous, the appeal will be dismissed. If it is not frivolous, the appeal will proceed. Briefing is stayed. If appellant does not respond to this order, the court may dismiss this appeal without further notice. The clerk will serve on appellant: (1) a form motion to voluntarily dismiss the appeal, (2) a form statement that the appeal should go forward, and (3) a Form 4 financial affidavit.
