| PER CURIAM ORDER [1823237] filed denying motion to consolidate [ # 1806348-2 ]. Granting motion to hold case in abeyance [ # 1807569-2 ] and conditional motion [ # 1809352-2 ]. The challenge in No. 19-1162 to the Environmental Protection Agencys conclusion that fuel blends containing more than 15% but less than 50% ethanol by volume are regulated "gasoline" under 40 C.F.R. Part 79 and Part 80 shall be severed from No. 19-1124, et al., assigned a new docket number, No. 20-1004, Urban Air Initiative, Inc. v. EPA, and be consolidated with No. 19-1161. The newly consolidated cases, No. 19-1161, et al., shall be held in abeyance pending further order of the court. Any intervenor in No. 19-1124, et al., who wishes to participate in No. 19-1161, et al., is directed to notify the court in writing within 30 days of the date of this order, and to indicate which party it supports. The EPA is directed to file status reports in No. 19-1161, et al. at 90-day intervals beginning 90 days from the date of this order. The parties are directed to file motions to govern further proceedings in No. 19-1161, et al. within 30 days of the completion of the agency proceedings. Before Judges: Srinivasan and Katsas.
