Filing 35 ORDER Denying 1 Application for Writ of Habeas Corpus filed by Bruce Edward Peterson. IT IS ORDERED that the Application for a Writ of Habeas Corpus Pursuant to 28 U.S.C. § 2254 1 is DISMISSED WITH PREJUDICE. It is FURTHER ORDERED that a certificate of appealability shall not issue because Applicant has not made a substantial showing of the denial of a constitutional right pursuant to 28 U.S.C. § 2253(c). It is FURTHER ORDERED that leave to proceed in forma pauperis on appeal is denied. The Court certifies pursuant to 28 U.S.C. § 1915(a)(3) that any appeal from this Order is not taken in good faith, and, therefore, in forma pauperis status is denied for the purpose of appeal. See Coppedge v. United States, 369 U. S. 438 (1962). If Applicant files a notice of appeal he must also pay the full $455 appellate filing fee or file a motion to proceed in forma pauperis in the United States Court of Appeals for the Tenth Circuit within thirty days in accordance with Fed. Filing 18 ORDER TO DISMISS IN PART AND FOR ANSWER IN PART AND STATE COURT RECORD. Claims One and Two are dismissed with prejudice as procedurally barred from federal habeas review. Within thirty days Respondents are directed to file an Answer in compliance w ith Rule 5 of the Rules Governing Section 2254 Cases that fully addresses the merits of the ineffective trial counsel claims as stated above. Within thirty days of the filing of the Answer Mr. Peterson may file a Reply, if he desires. Within thirty days from the date of this Order the Respondents shall file with the Clerk of the Court, in electronic format if available, a copy of the complete record of Mr. Petersons state court proceedings in Case No. 07CR7062, including all documents in the state court file and transcripts of all proceedings conducted in the state court, but excluding any physical evidence (as opposed to documentary evidence) not relevant to the asserted claims.
