Filing 53 ORDER ADOPTING FEBRUARY 10, 2017 RECOMMENDATION OF THE MAGISTRATE JUDGE AND DENYING WRIT OF HABEAS CORPUS. 1. The Recommendation of the United States Magistrate Judge 39 is ADOPTED. 2. Armelino's Objection 50 is OVERRULED; 3. Armelin o's Petition for Writ of Habeas Corpus 1 is DENIED; 4. Pursuant to 28 U.S.C. § 2253(c), no certificate of appealability will issue because Armelino has not made a substantial showing of the denial of a constitutional right; 5.Pursuan t to 28 U.S.C. § 1915(a)(3), any appeal from this Order would not be taken in good faith and therefore in forma pauperis status is denied for the purpose of appeal. See Coppedge v. United States, 369 U.S. 438 (1962). If Armelino files a notice of appeal he also must pay the full appellate filing fee (currently $505) or file a motion to proceed in forma pauperis in the United States Court of Appeals for the Tenth Circuit within thirty days in accordance with Federal Rule of Appellate Procedure 24; and 6. The Clerk shall enter final judgment in favor of Defendants and against Armelino, and shall terminate this case. The parties shall bear their own costs, by Judge William J. Martinez on 6/14/2017.
