November 27, 2017 Opinion or Order Filing 22 ORDER granting in part and denying in part #21 Motion for Extension of Time to Answer or Otherwise Respond: The requested 45-day extension is premised upon the filing of an amended pleading in the Gordon case that will incorporate the claims of the Plaintiffs herein, rending this action superfluous. The undersigned has reviewed the docket in Gordon and obseves that the parties there have been representing that they have been been prepared to file that amended pleading since October 6, 2017. Yet to date, no such amended pleading has been filed and the Gordon court has set no fixed deadline for it to occur in the future. Although the parties here may anticipate that further developments in Gordon may render this action superfluous, this Court is not inclined to wait indefinitely for those developments to occur. Rather, this Court intends to press forward regardless of the status of Gordon. Accordingly, the Court grants the Defendant's Motion to the extent that the Defendant's response to the Complaint shall be due on or before December 11, 2017, 14 days from the date of this Order, and that no further extensions will be granted.
