Filing 23 ORDER: The Recommendation 21 is adopted in its entirety. Plaintiff's Objection 22 is overruled. Defendants' Motion to Dismiss 13 is granted. Plaintiff's Fourteenth Amendment claim is dismissed with prejudice. The Court declines t o exercise its supplemental jurisdiction over Plaintiff's remaining state law claim of fraud and thus that claim is dismissed without prejudice.
