ORDER Affirming In Part and Vacating In Part Agency Action: The Court's Order to Show Cause 54 is discharged. The Service's May 18, 2018 final environmental assessment (R. at 3309) and May 18, 2018 incidental take permit issued to Garrett (R. at 3382) are vacated. This matter is remanded to the Service for further consideration of Garrett's application in light of the deficiencies described above, and consistent with this Order.
