ORDER After carefully reviewing the common questions of law and fact in 18-cv- 02238-WYD and 18-cv-02280-WYD and considering both judicial economy and fairness to both parties, I find that consolidation is appropriate under Rule 42(a) at least at this point in the proceedings. Once AP briefing is complete in 18-cv-02280-WYD, this consolidated action will be returned to the Clerk of the Court to be randomly drawn to the same judge for a decision on the merits. Accordingly, it is ORDERED that 18-cv-02238-WYD, K.S., et al. v. Mesa County Valley School District 51, is consolidated with 18-cv-02280-WYD, Mesa County Valley School District No. 51 v. Barry S., et al. for all further purposes. It is FURTHER ORDERED that 18-cv-002280-WYD shall be the lead case, and as of the date of this Order, all pleadings and other filings shall be filed in 18-cv-02280-WYD, using the caption appearing on this Order. Finally, it is ORDERED that the Clerk of Court shall docket this Order in 18-cv-02238-WYD, K.S., et al. v. Mesa County Valley School District 51, by Judge Wiley Y. Daniel on 10/2/2018. (evana, )
