Filing 5 ORDER OF DISMISSAL. The Prisoner COMPLAINT #1 and this action is DISMISSED WITHOUT PREJUDICE pursuant to Rule 41(b) of the Federal Rules of Civil Procedure for the failure of Plaintiff, Gerald Chavez, to comply with the February 19, 2019 Order Directing Plaintiff to Cure Deficiencies and to prosecute this action. ORDERED that the claims asserted against Defendants McAlester City Inspector, O. Carpenter, and Elizabeth Schleuter Snyder, are DISMISSED WITHOUT PREJUDICE for improper venue pursuant to 28 U.S.C. 1406(a). ORDERED that the pending motion (ECF No. 2) is DENIED as moot. Filing 4 ORDER DIRECTING PLAINTIFF TO CURE DEFICIENCIES AND TO SHOW CAUSE. That Plaintiff shall cure the deficiencies designated above within thirty (30) days from the date of this order. It is FURTHER ORDERED that the clerk of the court shall mail to Plaintiff a copy of the court-approved form for filing a Prisoner's Motion for Leave to Proceed Pursuant to 28 U.S.C. 1915. Plaintiff must use the form in curing the above-noted deficiencies. It is FURTHER ORDERED that Plaintiff shall show cause in writing, within thirty (30) days of this order, why his 1983 claims asserted against Defendants McAlester City Inspector, O. Carpenter, and Elizabeth Schleuter Snyder should not be dismissed without prejudice for improper venue or transferred to the judicial district where venue is proper. FURTHER ORDERED that if Plaintiff fails to comply with this Order, this action will be dismissed without further notice, by Magistrate Judge Gordon P. Gallagher on 2/19/2019.
