The Court adopts plaintiffs proposed schedule with the provisos that (1) depositions are to be conducted by telephone with the reporter, counsel, and involved parties at separate locations unless the current requirements for social distancing have been lifted by the time of the deposition, and (2) counsel shall be cooperative in making modifications to the schedule to the extent this might reasonably and necessarily be required by COVID-19 issues. ORDER denying #2 MOTION to Expedite Discovery and Request for Expedited Ruling. The Court is amenable to an accelerated discovery schedule and an accelerated Scheduling Conference. However, defendants have been served, and you must confer per local rule 7.1(a) (if defendants have retained counsel) and try to reach agreement on deposition dates and paper discovery response dates. If defendants fail to cooperate or provide a bunch of excuses as to why depositions cannot be set and proper paper discovery cannot be responded to on an expedited basis, then the Court will set the schedule, but defendants must in fairness have an opportunity to be heard. Also, I will not approve interrogatories or requests for production of documents such as your Exhibits A and B with the typical, but inappropriate, lengthy sets of definitions and instructions (nor will I condone the typical responses that begin with general objections and then incorporate the general objections into specific answers accompanied by "Subject to and without waiving those objections, defendant responds as follows:....").
